The following conditions form part of the Client's contract with African Encounter (Licence No. 2TA5644, ABN 57361655177), and herewith referred to as the Company. The signatory of the required Booking Form accepts these contract terms on behalf of everyone named in the booking or added subsequently, and the words "the Client" and/or "you" in these conditions should be construed accordingly.
Any quotation provided is based on pricing information currently available and may change prior to finalisation of the itinerary. All arrangements, and pricing, are subject to availability at the time of booking, major fluctuations in exchange rates, and any other unforeseen changes that are beyond the control of our company.
Bookings will be held as provisional until the company is in receipt of a 25% DEPOSIT as per your INVOICE or EMAIL NOTIFICATION from us. Once the receipt of funds has been verified you will be issued with a Confirmation Notice.
Full payment must be received by this office 60 days prior to the departure date of the safari unless otherwise arranged and confirmed in writing by ourselves.
On cancellations made outside 60 days prior to the departure date a charge of 25% of the total cost of the safari will apply i.e. the 25% deposit that has been received by this office will be retained in full.
For cancellations made 60 days or less prior to the departure date of the safari a charge of 100% of the total cost of the safari will apply i.e. full payment will be retained by this office.
These cancellation conditions should be covered by the client's travel insurance.
Accommodation which forms part of the Client's booking may only be used by the persons named on the booking form. Sub-letting is not permitted.
The Company shall not be held responsible or pay compensation where Force Majeure occurs, where Force Majeure means any unusual and unforeseeable circumstances beyond the Company's control, the consequences of which neither the Company nor its suppliers could avoid, including but not limited to war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, flood, adverse weather conditions or the threat of any of these.
Should we be forced to make a rate change this will not affect bookings held as confirmed. (National Park Fees and government levies being the exception and as such should be considered to be subject to change without notice). Please note that we do not take responsibility for missed connections caused by unexpected flight changes.
Any safari is potentially hazardous and it is essential that all lawful directions and advice of the safari operator and/or guides be followed. African Encounter will accept no responsibility for any illness, accident or loss whatsoever incurred in the course of the safari or for any expense from such illness, accident or loss.
African Encounter reserves the right to withdraw any safari, eliminate any feature or alter the itinerary, should local conditions necessitate. In such cases equivalent value substitutes will be offered or proportional refunds on the total safari price may be made.
We strongly advise that all travellers take out comprehensive travel insurance. This should be done prior to, or at the time of confirmation. All clients should be fully insured against accident, all medical eventualities and cancellation. African Encounter cannot be held responsible for loss or damage to baggage and personal effects, this should be covered by the client's insurance policy. Please note that insurance premiums are non-refundable. Should one or more member(s) of a party cancel it may increase the per person holiday price of those still travelling.
Any general information provided concerning passport, visa and health requirements are subject to change and the Client is responsible for checking current requirements before departure. It is the Client's responsibility to ensure that he complies with all applicable requirements and takes with him all documents required for his holiday. The Company will not be liable for any failure by the Client to discharge these responsibilities and the Client will have to reimburse the Company for any costs it incurs as a result of such failure on the part of the Client.
